Gary Petersen opened the meeting. The April Minutes were approved as written with no changes, deletions or corrections. .
Jim Curley reported that the owner of 142 is no longer responding to his calls and letters regarding the garage door. Therefore, an attorney will be involved from this point forward. The French doors will be removed and a regulation garage door will be installed and the homeowner will be responsible for the expenses, including the legal expenses. This has been on ongoing issue since April with promises from the homeowner that the problem would be solved.
Jim Curley Properties and NES seem to be playing “phone tag” regarding the street lights. June 6th is the “drop dead date” for communication. We are still waiting to see where and if we can put up additional lighting. One of the lights in Phase II is out again. This light needs to be check to see why it is going out so frequently.
We have had a number of requests about aeration of the lawns. Jim Curley Properties said this is done once a year in the fall, and is schedule to be completed this coming fall. As for reseeding bare spots in the yards, this is a problem. The areas have been reseeded, but unless the areas are watered frequently until the seeds have time to grow, we will continue to have bare spots. We will have to ask the homeowners to water these spots when they are reseeded again.
No parking signs will be installed at the end of the cul-de-sacs. Homeowners and/or guests are parking in these areas creating problems for the neighbors who can’t get out of their parking pads. Jim Curley has been asked to send letters to violators who are blocking their neighbor’s driveways. If letters don’t take care of the problems, cars will be towed. The visitor parking only signs will be going up soon in the visitor parking spaces.
Jim Curley has been asked to check on the termite contract. Termites have been reported by a couple of homeowners. We have a termite contract, so we want to make sure we are being protected.
The Board received a request from a homeowner requesting permission to put a hot tub on his balcony. Same requires were given to this homeowner: 1) proof that the foundation is structurally sound enough to hold the hot tub, and 2) the homeowner signs a waiver releasing the Association of all responsibility for damages caused due to the hot tub. The homeowner also had to provide the Board with a drawing of the planned changes. The Board approved this request, with the stipulation that construction cannot begin until the above requirements are satisfied.
The Greens has a number of units that have been purchased for rental property. This can cause all of us problems if too many properties become rental units. Jim Curley was asked to check into what it would take to have the CCRs changed to limit the number of properties allowed to be used for rental units. This is an issue that all homeowner would have to vote on. Mortgage companies will not lend money to prospective buyers if they feel there are too many units being used as rental property. If the CCRs are changed, it will not affect those units that are currently being used as rental property. More discussion is required before this matter is pursued.
The power washing and painting of the Phase One development has been put on hold. After checking with a number of roofing companies it has been determined that the roof on building one will have to be replaced due to poor workmanship when it was installed. This building has had problems almost since the beginning. Ghertner paid out a significant amount of money to repair the roof on building one, and then when the Homeowner’s Association took over, we continued to put money into the roof of this building. Barrett has given us the best deal, approximately $22,000. The contract will be signed and work scheduled to begin as soon as possible. The Board asked Jim Curley Properties to check into any recourse we may have in holding the developer responsible for at least a portion of this cost. It’s not promising, but we thought it should be checked into anyway. Jim Grinstead will write a letter to homeowners explaining the need to re-roof Building One. All the Board members will sign this letter.
The Annual Green’s picnic is going to be planned for September23rd. More information will be available closer to the time of the picnic.
Gary Petersen and Fran Oroson walked the property May 26th, taking notes of problem areas they saw and talking with homeowners. The following issues were discussed at the board meeting:
1. Some pet owners continue to disregard their neighbors, allowing their pets to leave droppings in yards and around mail boxes.
2. A brick was missing in one unit, close to the garage, where birds had built a nest. Jim Curley Properties will immediately take care of this problem.
3. The areas at the end of Building 300 and 301 needs to have some beautification done. Again grass seed will be planted and/or shrubs will be planted at the end of buildings.
4. A dead tree was found in the front of one unit. This will be replaced.
5. The mail truck has been seen driving over the curbs and actually across the yard next to the mailboxes. The post office will be notified of this problem and asked to make sure their drivers are sensitive to the damage they are doing to our property.
