Gary Petersen opened the meeting. The February Minutes were approved as written with no changes, deletions or corrections. The minutes from the Special Meeting held following Alan Botnik’s resignation and the Board’s appointment of Jim Grinstead to the Board were approved as written.
In February we had a resident who requested approval for adding onto his deck so he could install a hot tub. Although the Board approved this request with the stipulations that we receive a letter from a structural engineer stating the deck and footings were adequate to support the weight of the hot tub, and a letter indemnifying the Association from any damages caused due to the hot tub, these requirements were not received prior to the construction of the addition and placement of the hot tub. Jim Curley (Jim C) will be following up on this matter and if the requested information is not provided, then the addition and hot tub will have to be removed. This requirement is in accordance with the CCRs Article XI Architectural Standards, Section 1 Modification Committee, Paragraph 2, which, in summary, states all modifications to the outside of the condos must be submitted in writing to the Board for approval prior to any modifications being done. The Board has the right and obligation to approve or not approve such requests as outlined in the CCR. The Board meets the first Thursday of the month at which time all modification requests are reviewed. Jeff Nelson suggested that the Board produce a request form to be completed and signed by anyone requesting modifications to their unit. Jim Curley will work on this form.
Jim Grinstead (Jim G) asked about power washing the condos and doing something about the water stains on brick of some units. Jim C advised the units were power washed last year and were not scheduled to be done again this year; however, he will check the budget to see if it can be done again this year. He will also check the water stains on the brick to see what can be done to correct this problem.
Jim G, who lives on the golf course side of the community, brought samples of siding that has been broken off due to golf balls hitting his unit. The units that are brick on the back side are not being damaged like the vinyl units. Jim G advised that he was not requesting any special consideration. Jim C reported this is a damage that will need to be taken care of soon, not only to Jim G’s unit but all vinyl units, to prevent further damage behind the vinyl, such as water damage that could lead to more expensive repairs.
Jim C reported that he and the painters will be walking the community next week (March 6-10) to make a list of repairs that need to be taken care of before the painting is started.
An e-mail was received regarding a dented garage door. Jim C will check into this; if it was caused by the homeowner it is not the responsibility of the Association to repair the door.
A Special Meeting was held on February 5, 2006, by the Board to accept Alan Botnik’s resignation and to appoint Jim Grinstead to fill that vacancy. The Board is pleased that Jim accepted this appointment.
Jim Curley reported he has ordered two new street lights at a cost of approximately $2,500 each, which includes installation. Jeff Nelson suggested that one of the lights be installed close to the visitors parking and the mail boxes close to 172. That will give the newer section of our community three street lights. It was suggested that the other street light ordered be installed in the older section around unit 110. After these two street lights are installed the lighting situation will again be reviewed to determine whether or not additional lighting is needed. Lighting at the top of the hill will be reviewed after Vastland has completed the development of the condos on the other side of our community, as we don’t know what lighting they will be providing in that area.
Fran Oroson requested a motion to either pursue the closing of the street at the top of the hill or to make a motion to stop all discussion regarding this plan. It was agreed that:
1. the cost of such a request to Metro would be too expensive and the chances of it passing Metro Council would be slim.
2. plus the fire department would require at least 100 feet of space for turning their trucks around, which we don’t have, and
3. the fire department would also require this be done on the other side of our community, which means Vastland would also have to provide this space, and they are not willing to do so
Fran made the motion that this plan for closing the street at the top of the hill be taken off the list of things the Board has been discussing and no longer be considered an option. Jim G seconded the motion and the motion passed.
Gary reported that he had talked to Zee Terry at Ghertner about the planters blocking the street at the top of hill, should we remove them as they are there illegally. Zee said it would be okay for us to leave the planters there to discourage construction traffic from coming through our community; however, if we elected to remove the planters we should leave the no construction traffic sign up. If we see construction traffic using our streets we should report it to her and Vastland and/or Ghertner will see to it that it stops immediately.
Fran reported she had talked with Eric Aldridge again about the fence, lighting, curbs and landscaping. Eric reported that the fence will be completed as agreed to with the homeowner on the other side of our community, the landscaping will be done as soon as the landscaper can be scheduled, and the lighting he had not had time to check into but would be sending one of his guys to check into Greenvale’s obligation for street lighting. The broken curbs Vastland is not willing to repair unless we can prove they were broken by the contractors. He said the damage could have been done by the trash collectors or mail trucks or any other vehicle driving through the community. The Board decided to not do anything to repair the curbs until all the construction on the other side of our community is completed, then we’ll contact the contractor doing the curbs and see if we can piggyback into their work order.
Jeff asked about the possibility of putting a fence up between the condos facing each other between Nashboro Greens Way and Nashboro Greens Court. It was decided that if individual homeowners wanted to put up a privacy fence like the others in the community they could do so with approval from the Board. Once a privacy fence is installed that area is no longer attended to by the lawn care people, but it is the responsibility of the homeowner. Therefore, putting up a privacy fence between the condos in that area would require those homeowners to be responsible the care of the lawn.
Jim G and Jeff developed the website (www.nashborogreens.com) and have done a wonderful job according to the feed back the Board has received from the homeowners. One resident asked about a bulletin board for the homeowners to post to. Jim G advised that this would be too costly to provide. However, we do have the e-mail address for the Greens that the residents can use for their comments which can be posted on the website, such as requests for cleaning serves, babysitting services, pet care while you are away, etc. (nashborogreens@yahoo.com).
Jim C reported that he only received one response from the Board’s request for suggestions to solve our parking problem, and two requests for leasing a parking space. It was the consensus from the Association Meeting that the homeowners present were against leasing parking spaces, and since we only received one response (which was against leasing spaces) from our request for suggestions the Board elected to honor the one lease that has already been signed for a year and not to lease parking spaces to the two new requests, and to follow the CCRs regarding parking. That means homeowners with a single car garage have two parking spaces, one in the garage and one on the pad in front of their garage; and homeowners with a double car garage have four parking spaces, two in the garage and two on the pad in front of their garage. “Visitors Parking Only, Violators Will be Towed” signs will be placed in the visitor parking areas. Jim C will becoming through the area to take down license plate numbers to see who is violating this CCR regulation and appropriate action will be taken. The no parking on street signs are being ignored by some and their cars have been taped, the next step will be to tow the cars at the expense of the car owner. Anyone owning more cars than they have parking spaces for will have to find someplace to park their car(s) off premises.
The Board asked Jim C to check with the legal department to see if we had to have another Association Meeting in May to elect officers or if we could extend the current officer’s to January when we have our Annual Meeting to accept the budget. Jim C reported back that we could extend the term of office until the Annual Meeting or have a second meeting in May. The Board voted to extend the office term until the Annual Meeting, that way we would not have to ask the homeowners to attend a second meeting each year. A nominating committee will be appointed in accordance with the CCRs three months prior to the Annual Meeting. Three positions will be up for election in 2007 and two positions will be up for election in 2008. Term of office is two years with 2 or 3 positions being elected each year.
The notice received from Ghertner regarding the Nashboro Village Association Fees was discussed. When a unit is sold, the new homeowner is suppose to be advised of this Annual Fee paid to the Nashboro Village Association Master Plan, in addition to the monthly Association Fees paid to the Greens Homeowners Association. However, it usually isn’t done. The Master Associations includes everyone from Murfreesboro Road to Bell Road, this includes the Kroger’s shopping center, the golf course and some other none resident establishments. The Nashboro Village Master Association had an annual meeting to which our president, Gary Petersen, was not notified. Gary has since been in contact with Ghertner to find out why the Greens was not advised. He received an apology. Ghertner said the Master Association is looking into hiring four patrol cars to patrol Nashboro Village 24/7, this will not happen this year, but hopefully next year. Right now the Master Association is checking into the cost and probability. Gary will continue to keep in touch with Ghertner and to make sure he is included in the meeting next year to represent the Greens.
The next Board Meeting will be April 6, 2006 at 6:30 PM. Meeting place will be at the "Nashboro Golf Club" clubhouse.
